{"id":6566,"date":"2015-09-16T10:00:25","date_gmt":"2015-09-16T15:00:25","guid":{"rendered":"http:\/\/iowahighwayends.net\/blog\/?p=6566"},"modified":"2015-09-15T21:38:20","modified_gmt":"2015-09-16T02:38:20","slug":"digitaltown-appropriating-iowa-schools-names-for-profit","status":"publish","type":"post","link":"http:\/\/iowahighwayends.net\/blog\/2015\/09\/digitaltown-appropriating-iowa-schools-names-for-profit\/","title":{"rendered":"DigitalTown appropriating Iowa schools&#8217; names for profit"},"content":{"rendered":"<p>In retrospect, it&#8217;s an obvious strategy: Grab the domain names for every school district <del>in Iowa<\/del>, using the full name; follow that with the school nickname; make it a dot-com, since most official school district websites end in .k12.ia.us; and profit from those who aren&#8217;t paying attention. (EDIT: Not just Iowa, this is going on across the country.)<\/p>\n<p>In August, a <a href=\"https:\/\/finance.yahoo.com\/q\/pr?s=DGTW+Profile\">penny-stock company called DigitalTown<\/a> did just that. Now typing every [school][mascot].com from &#8220;keekeehawks&#8221; to &#8220;akronwestfieldwesterners&#8221; brings up a templated website with a district logo cribbed from somewhere, design accents in the school colors, and &#8220;[nickname]bucks&#8221;. DigitalTown is engaging <a href=\"http:\/\/www.nolo.com\/legal-encyclopedia\/cybersquatting-what-what-can-be-29778.html\">in a form of cybersquatting.<\/a><\/p>\n<p>The press releases couldn&#8217;t be more cookie-cutter or more obvious that they&#8217;re press releases, but it looks like local papers have fallen for it, including the <em>Traer Star-Clipper<\/em> and <em>Reinbeck Courier<\/em>. The latter&#8217;s website has deleted the page, <a href=\"http:\/\/webcache.googleusercontent.com\/search?q=cache:rXC0JQFxj8IJ:www.reinbeckcourier.com\/page\/content.detail\/id\/523758\/DigitalTown-announces-launch-of-gladbrookreinbeckrebels-com.html%3Fnav%3D5005+&amp;cd=2&amp;hl=en&amp;ct=clnk&amp;gl=us\">but it can be found in the Google cache.<\/a>\u00a0It bears all the hallmarks of a plug-and-chug text macro: Where the website is the first word in the sentence it is not capitalized, all the releases are missing a comma in the same place, and &#8220;Jack Londgren&#8221; is working in Iowa, <a href=\"http:\/\/www.eyeonannapolis.net\/2015\/09\/13\/digitaltown-launches-keyobezags-com\/\">Maryland<\/a>, and <a href=\"http:\/\/portlandtribune.com\/lor\/108-education\/271502-146957-school-notes\">Oregon<\/a>. An extra giveaway: The release\/website for North Tama uses &#8220;Red Hawks&#8221; as two words, which is incorrect.\u00a0<a href=\"https:\/\/www.facebook.com\/NTRedhawks\/posts\/867761796654149\">North Tama has put up a notice on its Facebook page<\/a>, which would be a good idea for everyone else to do too, and the <a href=\"http:\/\/redhawksupt.blogspot.com\/2015\/09\/beware-of-false-redhawks.html\">superintendent has a blog post about it<\/a>.<\/p>\n<p><em><strong>Iowa&#8217;s school districts have nothing to do with the DigitalTown websites. Schools will not receive any revenue through them.<\/strong>\u00a0<\/em>In fine, fine print at the bottom of each one is a disclaimer like this: &#8220;DigitalTown.com and its network are not affiliated with Bcluw Comets. All trademarks are held by their respective holders.&#8221; Yes, lowercased just like that.\u00a0<em>Even the disclaimer is an autofill blank.<\/em><\/p>\n<p>The <em>Fairfield Sun-Times<\/em> \u2014 not Fairfield, Iowa, but Fairfield, <em>Montana<\/em> \u2014 <a href=\"http:\/\/www.fairfieldsuntimes.com\/news\/article_357c3006-5667-11e5-9820-a7e4d7b2682d.html\">did some investigation<\/a>, and it gets more suspicious by the minute.<\/p>\n<p>Sports schedules and rosters are available in many places. But DigitalTown takes it further, attempting to sell ad space, offering e-mail addresses that use the school name and nickname, and<em> selling merchandise with the school&#8217;s name on it. <\/em>The &#8220;Team Stores&#8221; have all sorts of clothing designs but \u2014 and here&#8217;s another sign this whole thing is automated \u2014 the full name includes the nickname even where the nickname is listed separately. That leads to&#8230;this.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-6569\" alt=\"\" src=\"http:\/\/iowahighwayends.net\/blog\/wp-content\/uploads\/2015\/09\/AWSpartans-300x173.jpg\" width=\"300\" height=\"173\" srcset=\"http:\/\/iowahighwayends.net\/blog\/wp-content\/uploads\/2015\/09\/AWSpartans-300x173.jpg 300w, http:\/\/iowahighwayends.net\/blog\/wp-content\/uploads\/2015\/09\/AWSpartans.jpg 794w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>There is significant potential for confusion here, and that&#8217;s just what DigitalTown is banking on. I would argue that it amounts to false representation, something that can&#8217;t be avoided with a miniature disclaimer. The average Iowa school district isn&#8217;t concerning itself with the concept of snatching up every website related to it (see, for example, <a href=\"http:\/\/www.wired.com\/2015\/05\/carly-fiorina-website-mistake\/\">presidential candidate Carly Fiorina not buying the .org version of her name<\/a>), nor is it thinking about its name as a form of intellectual property or a reason to trademark it. One that HAS thought about it, though, is West Des Moines, <a href=\"http:\/\/www.wdmcs.org\/district\/logo-library\/\">which created new logos not that long ago and trademarked them<\/a>. And guess what \u2014 DigitalTown owns valleytigers.com.<\/p>\n<p>I intend to tell the IHSAA, IGHSAU, and the Iowa attorney general&#8217;s office about this. Even if state-level groups are not able to do anything \u2014 the individual districts may have to take action, and they aren&#8217;t going to be able to afford the lawyers \u2014 they can alert districts and Iowans that this is happening.
